Terms and Conditions

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

• Use a strong password and keep it secure
• Not share your account credentials with third parties
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities under your account

3.3 Account Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

FlwKit offers the following subscription plans:

• Subscriptions are billed monthly in advance
• Payments are processed through Polar.sh, our payment processor
• All fees are non-refundable except as required by law or as stated in these Terms
• You authorize us to charge your payment method for all fees due

4.3 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.4 Plan Limits

You agree to comply with the limits associated with your subscription plan. Exceeding plan limits may result in restricted access to features or require upgrading to a higher plan.

4.5 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• Upon cancellation, your account will be downgraded to the Free plan at the end of the billing period

5.1 Your Content

You retain ownership of all content, data, and materials you create, upload, or provide through the Service ("User Content"), including but not limited to:

• Onboarding flows and screen designs
• App configurations and settings
• Analytics data collected from your users
• Custom themes and styling

5.2 License to Use Your Content

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and transmit your User Content to provide the Service
• Use your User Content to improve and maintain the Service
• Create aggregated, anonymized analytics and insights

5.3 Your Responsibilities

You are solely responsible for:

• Ensuring you have all necessary rights and permissions to use User Content
• Complying with all applicable laws and regulations regarding User Content
• Ensuring User Content does not violate any third-party rights
• Backing up your User Content (we are not responsible for data loss)

5.4 Prohibited Content

You agree not to use the Service to create, upload, or distribute content that:

• Violates any applicable law or regulation
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Is defamatory, harassing, or discriminatory
• Violates privacy rights of others

6.1 Service Ownership

The Service, including all software, code, designs, graphics, logos, trademarks, and documentation, is owned by SIA ByteMind and protected by intellectual property laws. You do not acquire any ownership rights by using the Service.

6.2 SDK License

The FlwKit SDK is provided under a limited, non-exclusive, non-transferable license to integrate with your mobile applications solely for the purpose of using the Service. You may not:

• Reverse engineer, decompile, or disassemble the SDK
• Modify, adapt, or create derivative works of the SDK
• Remove or alter any proprietary notices in the SDK
• Use the SDK for any purpose other than integrating with FlwKit

6.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

7.1 API Access

You may access the FlwKit API using your API keys. You are responsible for:

• Keeping your API keys secure and confidential
• Not sharing API keys with unauthorized parties
• All activities performed using your API keys

7.2 SDK Integration

You may integrate the FlwKit SDK into your mobile applications. You agree to:

• Use the SDK only in accordance with our documentation
• Not attempt to circumvent or disable any security features
• Comply with all applicable app store guidelines and regulations

7.3 Rate Limits

We may impose rate limits on API usage to ensure service stability. Excessive usage may result in temporary or permanent restrictions.

8.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

8.2 Prohibited Activities

You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Resell, sublicense, or redistribute the Service or SDK
• Use the Service to compete with FlwKit
• Reverse engineer or attempt to extract source code
• Impersonate any person or entity
• Collect or harvest information about other users

9.1 Data Collection

We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to our data practices.

9.2 Data Security

We implement reasonable security measures to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

9.3 Your Users' Data

If you collect data from your end users through flows created with FlwKit, you are responsible for:

• Complying with all applicable privacy laws (GDPR, CCPA, etc.)
• Obtaining necessary consents from your users
• Securing and protecting your users' data
• Providing privacy notices and disclosures as required by law

10.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances.

10.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Add, remove, or modify features
• Change pricing and subscription plans
• Impose usage limits

10.3 Notice of Changes

We will provide reasonable notice of material changes to the Service, typically via email or in-app notifications.

11.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the dashboard.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You fail to pay fees when due
• You engage in fraudulent or illegal activity
• We discontinue the Service

11.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• You may export your data for 30 days after termination
• We may delete your account and User Content after the retention period
• All outstanding fees remain due

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIA BYTEMIND SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• SERVICE INTERRUPTIONS OR DOWNTIME
• DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

12.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.

14.1 Governing Law

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Latvia.

14.3 EU Consumer Rights

If you are a consumer in the European Union, you may have additional rights under EU consumer protection laws that cannot be excluded by these Terms.
